EXCERPT FROM JULY 18, 2006, PLANNING COMMISSION MEETING:
Comprehensive Plan Amendment Petition No. 06-5CP - S & J Properties - Owner: S
& J Properties of Southwest Florida, LLC - Agent: Jeffery A. Boone, Esquire -
Staff: Donald Caillouette, Comprehensive Planner
(4:43) Chair Osmulski stated the memorandum has been read, no written
communications have been received regarding this petition; and opened the public
hearing.
Staff Presentation
Mr. Caillouette displayed aerial and site photos, and a land use map, reviewed
surrounding land uses, summarized the petition stating there will be an impact to the
school system of eight to fifteen students, it is in compliance with DCA requirements, is
consistent with the comprehensive plan, and staff recommends approval.
Presentation
Mr. Boone concurred with the staff report, stated the amendment was required per the
pre-annexation agreement, the land use is comparable, noted a 150-foot easement running
between the property and Sorrento Ranches, made himself available to answer any
questions and requested approval.
(4:48) John Yurosko, Sorrento Ranches resident, stated his opposition to this petition
because it is not consistent with the comprehensive plan due to density issues.
(4:53) Bob Burrus, Sorrento Ranches resident, stated his opposition to this petition
because it is not consistent with surrounding land uses and the comprehensive plan due to
density issues.
Mr. Boone rebutted Mr. Burrus’ testimony regarding surrounding land uses, stated the
elementary school next to the S and J Property generates more intensive use and that this
petition is appropriate for this use and is consistent with Sarasota County plans for Laurel
Road.
(5:03) Chair Osmulski closed the public hearing.
(5:04) Mr. Weaver moved that based on the staff report and the presentation, the
Planning Commission, sitting as the local planning agency, finds this request inconsistent
with the Comprehensive Plan because it is not consistent or compatible with the low
density of adjoining properties and, therefore recommends to City Council denial of
Comprehensive Plan Amendment Petition No. 06-5CP. Seconded by Ms. Holloway.
Discussion followed regarding density in surrounding properties and lessening the impact
on surrounding properties.
